1. Agreement to Terms
By downloading, installing, or using Family Devotion (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
The Service is operated by Pearson Global Media, LLC, a limited liability company organized under the laws of the State of Florida ("Company," "we," "us," or "our").
2. Description of Service
Family Devotion is a Bible audio application that allows users to listen to Scripture and, on paid plans, create and use voice clones to hear Bible passages read in a personally meaningful voice. The Service is available via mobile application (iOS and Android) and web at familydevotion.app.
3. Accounts & Registration
To access certain features you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your password and account
- Notify us promptly at support@familydevotion.app of any unauthorized use of your account
- Take responsibility for all activity that occurs under your account
You must be at least 13 years of age to create an account. Users under 18 must have parental or guardian consent.
4. Subscriptions & Billing
Family Devotion offers free and paid subscription plans. By subscribing to a paid plan, you agree to the following:
- Recurring billing. Paid plans are billed on a recurring monthly or annual basis. Your subscription renews automatically unless cancelled before the renewal date.
- Cancellation. You may cancel your subscription at any time from your account dashboard or by contacting us. Access continues through the end of the current billing period. We do not provide prorated refunds for partial periods.
- Price changes. We reserve the right to change subscription prices. We will give you at least 30 days' notice before any price change takes effect.
- Refunds. All sales are final except where required by applicable law. If you believe you were charged in error, contact us within 30 days.
- Payments. Payments are processed securely by Stripe. We do not store your payment card information.
Voice Minute Top-ups. Additional voice minutes purchased as top-ups are non-refundable and do not expire as long as your account remains active.
Church Edition. Church subscriptions are billed to the church administrator. Individual church members are not charged unless they independently upgrade their personal account.
5. Free Trial
New accounts receive a 7-day free trial of the Family Plan. During the trial:
- No payment information is required to start the trial
- You have access to all Family Plan features, including voice cloning (up to the trial voice minute limit)
- At the end of 7 days, your account automatically converts to the free tier unless you subscribe to a paid plan
- Voice clones created during the trial are preserved but become inaccessible until you upgrade — they are not deleted
We reserve the right to limit one free trial per person or household. Creating multiple accounts to exploit the trial period is a violation of these Terms and may result in account suspension.
6. Gift Subscriptions
Gift subscriptions allow you to purchase a Family Plan subscription on behalf of another person.
- Gift purchases are processed immediately and are non-refundable once the gift code has been redeemed
- Unredeemed gift codes are refundable within 30 days of purchase — contact us at support@familydevotion.app
- Gift subscriptions do not auto-renew; the recipient's account returns to the free tier when the gift period expires
- We are not responsible for gift codes lost, stolen, or used without the purchaser's authorization
7. Affiliate Program
Family Devotion operates a referral program through which eligible users can earn commissions for referring new paying subscribers.
- Commissions are earned only on new subscriptions where the referred user enters your referral code at signup and completes a payment
- Commission rates and payment schedules are communicated at enrollment and may be updated with 30 days' notice
- Payouts are made through Stripe Connect. You must complete Stripe's identity verification to receive payouts
- We reserve the right to withhold or reverse commissions for fraudulent referrals, self-referrals, or accounts created to abuse the program
- Participation in the affiliate program is subject to separate Affiliate Program Terms provided at enrollment, which incorporate these Terms by reference
We may suspend or terminate your affiliate account at any time if we suspect abuse. Legitimate pending commissions will be honored upon termination.
8. Push Notifications
By using the Service on a mobile device, you may be asked to grant permission to send push notifications. If you grant permission:
- Your device's push token is stored and used to deliver church broadcasts, devotion reminders, and account alerts
- You can withdraw consent at any time by disabling notifications in your device settings
- Church administrators may send broadcasts to all members of their church — the content of those broadcasts is the responsibility of the church administrator, not Pearson Global Media, LLC
We are not liable for the failure to deliver push notifications due to device settings, carrier restrictions, or third-party service interruptions.
9. Voice Cloning
The voice cloning feature allows you to create an AI-generated voice clone using a recorded audio sample. By using this feature, you represent and warrant that:
- You have the explicit consent of any person whose voice you are cloning
- You will use voice clones solely for personal, non-commercial devotional purposes within the Service
- You will not use voice clones to impersonate any person, create deceptive content, or for any unlawful purpose
- You are the rightful owner of or have permission to use any audio recordings you submit
Voice recordings and clones are processed by ElevenLabs, Inc. pursuant to their terms of service. We reserve the right to remove any voice clone that violates these Terms or applicable law.
You may delete your voice clones at any time from within the app or your account dashboard. Deletion from our systems may take up to 30 days due to processing by third-party providers.
10. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Infringe the intellectual property rights of any third party
- Upload, transmit, or distribute malicious code or harmful content
- Attempt to gain unauthorized access to any part of the Service or its related systems
- Use automated tools to scrape, crawl, or extract data from the Service
- Resell, sublicense, or commercially exploit the Service or its content without our written permission
- Create voice clones of public figures, celebrities, or other individuals without their consent
11. Intellectual Property
The Family Devotion name, logo, app design, and all related content (excluding Bible text) are the property of Pearson Global Media, LLC and are protected by copyright, trademark, and other intellectual property laws.
You retain ownership of voice recordings you submit. By submitting a recording, you grant us a limited license to process and store it solely for the purpose of providing the Service to you.
12. Bible Content & Third-Party Services
Bible text is provided through third-party APIs and is used in accordance with applicable open licenses (including the World English Bible translation, which is in the public domain). We make no claim of ownership over biblical text.
The Service integrates with third-party providers including ElevenLabs (voice processing) and Stripe (payments). Your use of features powered by these providers is also subject to their respective terms of service and privacy policies.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PEARSON GLOBAL MEDIA, LLC DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PEARSON GLOBAL MEDIA, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50.
15. Termination
We may suspend or terminate your account at any time if we believe you have violated these Terms, with or without notice. You may delete your account at any time from your dashboard or by contacting us.
Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, and limitations of liability.
16. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of such courts.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Effective" date at the top of this page. For material changes, we will notify you by email or by a prominent notice within the Service. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
